Cancellation notice for business customers

No statutory right of withdrawal

The statutory right of withdrawal pursuant to §§ 312b et seq. BGB applies exclusively to consumers within the meaning of § 13 BGB.

CutCue is exclusively directed at entrepreneurs within the meaning of § 14 BGB. By registering, you confirm that you are acting in the course of your commercial or independent professional activity. Therefore, no statutory right of withdrawal exists.

Who is an entrepreneur within the meaning of § 14 BGB?

An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity. This includes:

• GmbH, UG, AG, OHG, KG and other companies
• Sole traders, freelancers, self-employed individuals
• Associations and legal persons, where acting commercially

Your cancellation options

Ordinary cancellation

You may cancel your subscription at any time effective at the end of the current billing period — by email to contact@cutcue.io or via account settings (cancellation is processed via Lemon Squeezy as payment service provider).

Extraordinary cancellation for good cause

If CutCue seriously breaches the contract, you may cancel extraordinarily and without notice. In that case, CutCue will refund the pro rata amount for the remaining billing period.

What happens after cancellation?

• The subscription ends at the end of the current billing period.
• Subscription credits and rollover credits may be used until the end of the last paid billing period.
• After the billing period ends, rollover credits continue with the scheduled expiry periods: Starter: 30 days from creation; Creator: 60 days from creation; Studio: 90 days from creation.
• Package credits are retained indefinitely but are frozen without an active subscription. As soon as you conclude a new subscription, they become available again.
• After active account deletion, all credits and personal data are irreversibly deleted. After 24 months of inactivity without an active subscription, CutCue may automatically delete the account.

No refund

Subscription fees already paid are generally not refunded — whether you cancel or CutCue cancels — unless mandatory statutory provisions or an extraordinary cancellation provide otherwise. Consumed credits are deemed fully performed digital services and are not reclaimable.

Cancellation by CutCue

CutCue may cancel the subscription on ordinary notice with 30 days' notice. In the event of serious violations (e.g. abuse, chargeback fraud, attacks on the infrastructure), CutCue is entitled to terminate extraordinarily without notice and block the account immediately. In that case, no fees will be refunded.

Special right of cancellation

You have a special right of cancellation in the event of price increases or adjustments to credit costs. CutCue announces such changes by email at least 30 days in advance. You may then cancel until the change takes effect without observing the regular notice period.
